By accessing or using Serververse's services, you acknowledge that you have read, understood and agree to be bound by these Terms. If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. We reserve the right to modify these Terms at any time. We will provide notice of any material changes through our website or by sending an email to the address associated with your account. Your continued use of our services after such modifications constitutes your acceptance of the modified Terms. Serververse provides web hosting, server hosting, cloud computing and related services as described on our website. We reserve the right to modify, suspend or discontinue any part of our services at any time without prior notice. Service specifications, including but not limited to storage capacity, processing power, bandwidth and features, are as described on our website at the time of purchase. We may update these specifications from time to time to improve our services. Our Service Level Agreement (SLA) outlines our commitments regarding service availability, performance and support response times. The SLA is incorporated into these Terms by reference.
To access certain features of our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current or incomplete. You are responsible for all content and activity on your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
You agree to pay all fees associated with your use of our services. Fees are non-refundable except as expressly provided in our Refund Policy or as required by law. For subscription-based services, you will be billed on a recurring basis at the then-current rates. Billing cycles are set on a monthly or annual basis, depending on the subscription plan you select. You authorize us to charge the payment method you provide to us for all applicable fees. If your payment cannot be completed, we may suspend or terminate your access to our services. We may change our fees and payment policies by posting the changes on our website or by notifying you directly. Changes to fees will not apply retroactively and will take effect at the start of the next billing cycle after the changes are posted.
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden or impair our services. Prohibited activities include, but are not limited to: • Violating any applicable laws, regulations or third-party rights • Distributing malware, viruses or other malicious code • Engaging in unauthorized access to any system, network or account • Conducting denial-of-service attacks or other disruptive activities • Distributing unsolicited commercial messages (spam) • Hosting, distributing or linking to content that is illegal, harmful or offensive • Using our services to mine cryptocurrency without our express written permission • Reselling our services without our express written permission • Hosting or distributing NSFW content, including pornography, adult material or any content deemed inappropriate • Engaging in forex trading or related activities Violation of this section may result in immediate termination and potential legal action.
You may terminate your account at any time by following the instructions on our website or by contacting our customer support. Upon termination, you will remain liable for all fees incurred before termination. We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. If you are found defaming Serververse, abusing our staff or poaching our customers, partners or staff, we may seize, terminate or take over your resources immediately, without prior notice. Penalties may be imposed and you may face legal notices or other legal action. Upon termination, your right to use our services will immediately cease. We may delete your account and all associated data after termination. We are not responsible for the loss of any data resulting from termination.
Our services and all content, features and functionality thereof, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations and software, are the property of Serververse or our licensors and are protected by copyright, trademark and other intellectual property laws. You retain ownership of any content you upload, submit or display through our services. By uploading, submitting or displaying such content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, modify, publish and distribute such content for the purpose of providing our services to you.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR THE SERVERS THAT MAKE OUR SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
IN NO EVENT SHALL SERVERVERSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM: • Errors, mistakes or inaccuracies of content • Personal injury or property damage resulting from your access to and use of our services • Any unauthorized access to or use of our servers and/or any personal information stored therein • Any interruption or cessation of transmission to or from our services • Any bugs, viruses, Trojan horses or the like, which may be transmitted to or through our services by any third party • Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted or otherwise made available via our services THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
You agree to defend, indemnify and hold harmless Serververse, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt and expenses (including but not limited to attorney's fees) arising from: • Your use of and access to our services • Your violation of any term of these Terms • Your violation of any third-party right, including without limitation any copyright, property or privacy right • Any claim that your content caused damage to a third party This defense and indemnification obligation will survive these Terms and your use of our services.
You agree not to make any false, misleading or disparaging statements about Serververse, its services, employees or affiliates. If you defame Serververse through false statements or malicious actions, we reserve the right to take any necessary legal action to protect our reputation, including seeking damages and injunctive relief.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Serververse is established, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be resolved exclusively in the courts located in our jurisdiction. You consent to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction by such courts. Serververse respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our designated agent with: • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest • A description of the copyrighted work that you claim has been infringed • A description of where the material that you claim is infringing is located on our site • Your address, telephone number and email address • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf For more information, visit copyright.gov/dmca.
Entire Agreement: These Terms, together with our Privacy Policy, Refund Policy, SLA, AUP and any other legal notices published by us on our website, constitute the entire agreement between you and Serververse concerning our services. Severability: If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. Assignment: You may not assign or transfer these Terms, by operation of law or otherwise.
By accessing, purchasing, registering for or using any Serververse website, service, platform, infrastructure, billing system, network or related offering, you acknowledge and agree that acceptance of these Terms of Service automatically constitutes your full acceptance of all legal documents, policies, rules and agreements published, referenced or enforced by Serververse. This includes, but is not limited to: • Privacy Policy • Refund Policy • Service Level Agreement (SLA) • Acceptable Use Policy (AUP) • Cookie Policy • Billing Policies • Abuse Policies • Security Policies • Data Processing or Compliance Policies • Product-Specific Terms • Promotional Terms • Enterprise or Custom Service Agreements • Any future legal, operational or compliance documents implemented by Serververse You also agree to comply with company rules, internet and international compliance rules and non-listed but enforceable policies where reasonably necessary to protect infrastructure, prevent abuse, enforce fraud prevention, maintain network stability, comply with legal obligations and protect customers, partners or third parties.
If you do not agree to all current or future Serververse legal documents, operational rules or mandatory compliance obligations, you must immediately discontinue use of all Serververse services. Your continued use of Serververse constitutes legally binding acceptance of all such terms, policies and obligations in full. All services are billed on a date basis, not exact activation hour basis. Services may be suspended anytime after the due date if payment is not received.
