Fair Usage Policy

Reasonable use, bandwidth rules, reactivation after exhaustion, data retention after expiry and related limits for Serververse services.

Applies with our Terms, AUP, Refund Policy and SLA. Product pages may state plan-specific allowances.

1. Fair Usage Policy (FUP)

Resources must be used within reasonable limits for the plan you purchased. • Continuous excessive usage may result in throttling or suspension. • Unusual traffic spikes may be investigated. • Shared and metered services must not degrade other customers or the Serververse network. This Fair Usage Policy applies together with our Terms, AUP, Refund Policy and SLA.

2. Provisioning & Downgrade Policy

2.1 Downgrade Policy Once a service is provisioned and delivered, it cannot be downgraded. Upgrades are allowed where inventory and product rules allow. Downgrades are not offered. 2.2 Bandwidth Usage Policy Each service includes a defined bandwidth allowance (or fair-use limits for the product). If the included bandwidth is exhausted on a metered plan, the service may be automatically suspended until additional capacity is purchased or the cycle resets, depending on the product. 2.3 Suspension Due to Bandwidth Exhaustion While suspended for bandwidth exhaustion, services may become inaccessible. Data typically remains on disk but is not available until the suspension is cleared per the product rules.

3. Reactivation & Data Access

To restore a service suspended for bandwidth exhaustion or unpaid dues, you must purchase additional bandwidth or settle applicable charges through the store. Only after payment clears: • Suspension may be lifted • Services may be restored • Data access may be enabled again Important: • No free data access after bandwidth exhaustion on metered products • Continued service requires sufficient allowance or an active paid period • Emergency access requests are handled case by case through support channels on /contact

4. No Refund After Bandwidth Consumption

4.1 No Refund After Usage Once any bandwidth is consumed on a metered service or the service is accessed or deployed, refunds are not issued for that billing period except where our Refund Policy expressly allows. 4.2 Definition of Usage A service is considered used if any of the following occur: • Any bandwidth is consumed • The service is accessed, deployed or powered on • Any network activity is recorded against the service 4.3 Non-Refundable Scenarios • Partial or full bandwidth usage • Suspension due to bandwidth exhaustion • Customer misconfiguration • Lack of technical knowledge • Change of mind • Policy violations under the AUP or Terms See also /refund-policy for the full refund rules.

5. Payment & Renewal Policy

5.1 Prepaid Services Services are prepaid unless a written enterprise agreement says otherwise. Services activate after payment clears. 5.2 Non-Payment & Suspension Failure to pay before the due date may result in suspension. During suspension, data access, backups and file exports may be withheld until dues and any reactivation charges are paid. 5.3 Renewal Policy Renew before the due date to avoid suspension. Failure to renew may lead to suspension and later deletion under the retention rules below.

6. Data Retention & Deletion Policy

6.1 Suspension or Expiry After suspension or expiry, Serververse may retain service data for a limited window (typically up to 5 days for standard plans, unless a product page or written agreement states otherwise). 6.2 Permanent Deletion After the retention window, data may be permanently deleted. Recovery is not guaranteed. 6.3 Backups You are responsible for your own backups. Do not rely on Serververse retention after expiry. 6.4 Final Notice Data loss from non-renewal, suspension or policy enforcement is the customer’s responsibility. No claims are accepted after deletion.

7. Service Disclaimer

• Services are provided as-is and as-available unless a written SLA or enterprise contract states otherwise. • No guarantee of uninterrupted or error-free service by default (see /sla). • Serververse is not liable for data loss, business loss, revenue loss, downtime or interruptions beyond what the SLA or applicable law requires. • Where liability is limited by contract, maximum liability is typically limited to fees paid for the affected service in the prior 30 days, except where law requires otherwise.

8. Jurisdiction
